PUBLIC AGREEMENT (OFFER)
on Payment of a Membership Fee
to the Public Organization “Association of Ukrainian Cowboys”
This Agreement constitutes an official and public offer of the Public Organization “Association of Ukrainian Cowboys” (hereinafter – the Organization) to enter into an agreement on payment of a membership fee in support of the Organization’s statutory activities.
This Agreement is public in accordance with Article 633 of the Civil Code of Ukraine. Its terms are identical for all persons making membership fee payments via the Organization’s official website.
The Agreement shall be deemed concluded at the moment the Participant makes a membership fee payment through the Organization’s website.
1. Definitions
1.1. Public Offer (Offer) means a public proposal of the Organization addressed to an indefinite number of persons to enter into this Agreement on payment of a membership fee in support of the Organization’s statutory activities (hereinafter – the Agreement) under the terms set forth herein.
1.2. Organization means the Public Organization “Association of Ukrainian Cowboys” (EDRPOU code 46008236), established and operating in accordance with the laws of Ukraine, having its registered address at: 04071, Kyiv, Naberezhno-Luhova Street, building 3.
1.3. Participant means an individual who has reached the age of 18, makes a membership fee payment through the Organization’s website and accepts the terms of this Agreement.
1.4. Membership Fee means a monetary contribution of the Participant aimed at supporting the statutory activities of the Organization.
1.5. Organization’s Website means the website through which membership fee payments are made online.
2. Subject of the Agreement
2.1. The Organization accepts from the Participant a membership fee to support its statutory activities.
2.2. The Participant voluntarily pays the membership fee in the amount specified on the Organization’s website. Payment of the membership fee does not constitute payment for goods or services and does not create consumer or commercial legal relations.
2.3. Payment of the membership fee through the Organization’s website constitutes acceptance of the terms of this Agreement.
2.4. Payment of the membership fee is not a purchase of goods or services and is non-commercial in nature.
3. Procedure for Payment of the Membership Fee
3.1. The Participant makes the membership fee payment via the payment form available on the Organization’s website.
3.2. When making a payment, the Participant undertakes to provide the following information: full name, email address, and contact phone number.
3.3. The Participant is responsible for the accuracy of the provided information.
3.4. After payment, information about the transaction is recorded in the Organization’s internal database.
4. Amount and Payment Procedure
4.1. The amount of membership fees is determined by the governing bodies of the Organization and is published on the website.
4.2. Payment of the membership fee is made online via payment systems available on the website.
4.3. The Participant’s payment obligation shall be deemed fulfilled upon crediting of funds to the Organization’s bank account.
5. Rights and Obligations of the Parties
5.1. The Organization undertakes to:
5.1.1. use the received funds exclusively for statutory activities;
5.1.2. ensure confidentiality of the Participant’s personal data;
5.1.3. inform Participants about the Organization’s activities.
5.2. The Organization has the right to:
5.2.1. amend the terms of this Agreement by publishing a new version on the website;
5.2.2. determine the amount of membership fees.
5.2.3. the Organization reserves the right, at its sole discretion, to refuse granting membership to any person without providing reasons for such refusal.
5.3. The Participant undertakes to:
5.3.1. review the terms of this Agreement prior to making a payment;
5.3.2. provide accurate information when making a payment.
6. Refund of Membership Fees
6.1. Membership fees are voluntary payments made to support the Organization’s statutory activities.
6.2. Refunds may be made in case of an erroneous or technically incorrect payment, as well as in other cases provided for by the legislation of Ukraine.
6.3. In the event the Organization refuses to grant membership to a person, the paid membership fee shall be refunded in full to the same payment method used for the original transaction or by another method agreed upon by the parties.
6.4. In the event of a refund of the membership fee, the Organization shall return the amount of funds actually received. Bank and payment system fees charged during the payment or refund process shall not be reimbursed to the Participant.
7. Liability of the Parties
7.1. The Parties shall bear liability in accordance with the legislation of Ukraine.
7.2. The Organization shall not be liable for technical failures of payment systems or the Internet.
7.3. The Parties shall be released from liability for non-performance of their obligations in the event of force majeure circumstances (war, natural disasters, emergencies, etc.).
8. Confidentiality and Personal Data
8.1. By providing personal data during payment, the Participant consents to their processing in accordance with the Law of Ukraine “On Personal Data Protection”.
8.2. The Organization undertakes to use personal data exclusively for the purposes of its statutory activities and interaction with Participants.
9. Miscellaneous
9.1. This Agreement is concluded within the territory of Ukraine and is governed by the laws of Ukraine.
9.2. All disputes arising between the Parties shall be resolved through negotiations.
9.3. If a dispute cannot be resolved through negotiations, it shall be settled in court in accordance with the legislation of Ukraine.
